Roundup Lawsuit
(Weed Killer Exposure Linked to Cancer)
Problem summary
People all over the country exposed to Roundup at work or at home are filing lawsuits against Monsanto, claiming that the company was negligent in failing to warn consumers that the popular weed killer may put them at risk for developing a deadly cancer called non-Hodgkin’s lymphoma. The lawsuits challenge Monsanto’s claims that its glyphosate-based herbicides are proven safe and assert that the company hid the dangers of Roundup from the public, citing research showing that glyphosate and glyphosate formulations can lead to non-Hodgkin’s lymphoma and other serious illnesses. Roundup is currently the most widely-used herbicide in the world, and from landscapers to farmers to home gardeners to migrant workers, anyone exposed to the herbicide could be at an increased risk of cancer.
About Roundup
Roundup is a broad-spectrum herbicide manufactured by Monsanto and commonly used to kill weeds and grasses that are either unattractive or that damage crops. Since glyphosate’s usefulness as a weed killer was discovered in the 1970s, its use has increased dramatically in terms of frequency and amount of application, due in large part to Monsanto’s expansion of genetically modified (GMO) crops designed to resist the killing power of glyphosate. Today, approximately 250 million pounds of glyphosate are sprayed on crops, lawns, parks, golf courses, commercial nurseries and sidewalks every year.
Although Roundup has been the best-selling weed killer in the United States for more than 40 years, a growing body of evidence suggesting that Roundup exposure may increase the risk of non-Hodgkin’s lymphoma has raised serious concerns about the herbicide’s safety. In 2015, the International Agency for Research on Cancer (IARC) released a report naming glyphosate, Roundup’s active ingredient, a “probable carcinogen,” and in 2017, the State of California became the first U.S. government entity to declare glyphosate to be a known carcinogen. In spite of these findings, Monsanto publicly stands by the safety of its product. However, internal company documents suggest that the company has long been aware of the potential carcinogenic effects of Roundup and has continuously sought to influence scientific literature regarding Roundup’s safety and prevent these concerns from reaching the public.
Evidence against Monsanto recently unsealed in court suggests that the company may have ghostwritten research that was later attributed to academics and called on a senior official at the EPA to prevent the U.S. Department of Health and Human Services from conducting its own review of glyphosate’s safety. Even more alarming than that, in one 2003 internal company email, a Monsanto scientist wrote, “You cannot say that Roundup is not a carcinogen…we have not done the necessary testing on the formulation to make that statement.” Another email from 2002 stated, “Glyphosate is OK but the formulated product…does the damage.” And yet another email from 2010 said, “With regards to the carcinogenicity of our formulations we don’t have such testing on them directly.”

Roundup Side Effects
The most serious side effect linked to Roundup exposure is the development of cancer, specifically non-Hodgkin’s lymphoma and its many subtypes, such as diffuse large B-cell lymphoma, follicular lymphoma, chronic lymphocytic leukemia, mantle cell lymphoma and hairy cell leukemia. According to reports, the individuals most at risk for developing non-Hodgkin’s lymphoma are those regularly exposed to Roundup at work, which may include landscapers and employees in garden centers and nurseries, although anyone who uses Roundup frequently on their own lawn or home garden may also face an increased risk of cancer. Symptoms of non-Hodgkin’s lymphoma include swollen lymph nodes, chest and stomach pain, fever, night sweats and loss of appetite.

Roundup Settlements & Litigation
In the midst of mounting evidence concerning the potential carcinogenic effects of Roundup weed killer, some 4,000 plaintiffs have already sued Monsanto for Roundup exposure that they claim caused them or their loved ones to develop non-Hodgkin’s lymphoma. As of May 2018, more than 400 lawsuits were pending in the Northern District of California, where the federal Roundup multi-district litigation (MDL) is being overseen by Judge Vince Chhabria and thousands of similar claims are pending in state courts across the country. In June 2018, a father of three in California became the first person to take Monsanto to trial on allegations that the company spent decades hiding the cancer risk of Roundup herbicide products.
The ongoing Roundup litigation involves allegations that Monsanto knew or should have known for more than 30 years about the potential link between Roundup use and cancer, but intentionally withheld this information from the public and misleadingly marketed the potentially dangerous product as non-toxic and proven safe. Roundup lawsuits filed on behalf of individuals diagnosed with cancer and their loved ones seek financial compensation for past and future medical expenses, pain and suffering, lost wages, loss of future earning capacity, funeral costs and other damages.
